It has been confirmed that on Monday 12 September 2011, the Council of the European Union
agreed to extend the copyright term for performers and record companies to 70 years from the
release of the recording. The term used to be 50 years. That probably seemed enough. Who could
predict how popular those old recordings would be? The means for example that Cliff Richards
1958 recording of Move It
will stay in copyright until 2028. It also prevents the Beatles early
sixties records such as Love Me Do
which was released in 1962 from falling out of copyright next year.
The PPL who represent record companies have spent the last ten years lobbying the council for this
decision.

It is important to note that the copyright of the song is not affected by this decision. This only relates
to the copyright of the sound recording. There are two copyrights that exist for a record,
a copyright in the song which is shared between the publisher and the songwriter and the copyright of
the recording which is owned by the record company that released it.
